MJPM' BUSINESS POLICY
Effective as of May 1, 2024
MEMBERSHIP APPLICATION
1.1 Only individuals who have attained the age of majority in Malaysia of eighteen (18) years are eligible for membership.
1.2 Membership is free and available through a referral link or with an initial product purchase on the website. Paid membership is not permitted according to MJPM’s Company Policy.
1.3 Memberships without an initial purchase within three (3) months from registration will be automatically terminated without prior notice. However, terminated members may reapply if needed.
1.4 MJPM reserves the right to reject any application with incomplete or inaccurate details without providing reasons to the applicant.
1.5 The account validity period is twelve (12) months from the month of registration. A product purchase within this period extends the account validity by another twelve (12) months. Failure to renew validity will result in inactive membership.
1.6 Members are allowed to appoint a beneficiary, limited to family members only.
1.7 The beneficiary can assume possession of the inheritance due to old age, emigration, disability, or death. The beneficiary must be an immediate family member, aged 18 years or older, meeting eligibility requirements, and capable of fulfilling duties and responsibilities.
1.8 Members who recruit and build a business network are recognized as Independent Direct Sellers. They must uphold honesty and trustworthiness, and present information truthfully. They are prohibited from using fraud, coercion, harassment, or any unlawful means to promote the business or recruit members.
1.9 MJPM reserves the right to revoke membership without prior notice and without providing reasons.
1.10 Changes of placement or sponsoring/recruitment information are strictly prohibited post-registration, except in cases of unintentional human error, and must be requested in writing. The company reserves the right to approve or decline such requests.
1.11 Spouses may recruit each other directly but must remain within the same hierarchy. If the second spouse is recruited into a different line for any reason, the company reserves the right to transfer the distributorship to the first spouse's hierarchy.
1.12 Membership does not create an employer/employee relationship, agency, partnership, or joint venture between the company and Independent Direct Sellers. Independent Direct Sellers have no authority to bind MJPM with any third party or business organization and are responsible for their business conduct. MJPM will not be responsible for any misconduct by Independent Direct Sellers that violates the company’s code of conduct or laws. Independent Direct Sellers are liable for damages resulting from their actions.
1.13 Independent Direct Sellers shall indemnify the company against any claims, damages, or liabilities arising from their business practices. They are encouraged to operate their MJPM business independently, with remuneration and expenses borne by themselves.
MONTHLY MAINTENANCE
2.1 A minimum monthly maintenance of 150BV is required for commission eligibility. Failure to meet this requirement will result in forfeiture of commissions, rank promotions, and related benefits for that month.
2.2 Maintenance closes on the last day of each month. Late performance will result in forfeiture of commissions, rebates, rank promotions, and related benefits.
2.3 Failure to maintain for a consecutive twelve (12) months from the last product purchase will result in account termination. All rights and privileges will be voided upon termination.
PRODUCT ORDERS AND PAYMENT
3.1 Payment can be made through the payment gateway on the website. Upon confirmation, products will be received within 3-7 business days.
3.2 Members should verify product details on the receipt before leaving the premises or website. Disputes or defects must be reported within forty-eight (48) hours after purchase, otherwise, goods are non-returnable and non-refundable.
3.3 The recipient must check and verify the delivery at the time of receipt before signing any documents. Issues such as discrepancies, shortages, excesses, or damage should be reported to the representative and the company within two (2) days of delivery.
SALES CLOSING
4.1 Sales performance is reviewed and cut off on the last day of each month. For example: 28th February 2024, 31st January 2024, 30th September 2024.
4.2 Sales or purchase submissions can be done through our website to avoid disappointment.
4.3 MJPM will not entertain late submissions or purchases of the said month. Members are advised to submit and ensure their payout validity before the last day of the month.
4.4 Late submissions will be disregarded without explanation.
DATE OF COMMISSION PAYOUT
5.1 Commissions are entitled to members with active accounts and valid maintenance periods.
5.2 The total commission payout is subject to the level of qualification based on MyPlan’s Business Plan.
5.3 Payout date is the 12th of the following month. If the date falls on a weekend or public holiday, the commission will be transferred on the next business day.
5.4 Commissions will be directly transferred to the member’s bank account. Members must provide accurate bank account information. MJPM is not responsible for errors provided by third parties.
SPONSORSHIP OR RECRUITMENT
6.1 New members should be informed of MJPM’s policies and code of ethics by their direct sponsor/recruiter.
6.2 Members must not publicize or promote products deceptively or misleadingly.
6.3 Members are forbidden from changing their placement or recruitment information.
6.4 In the event of a substantiated complaint:
- 6.4.1 The member signing up another member or spouse from a different group may be terminated or given a final warning.
- 6.4.2 All involved members will be transferred back to their original sponsorship/hierarchy.
- 6.4.3 Bonuses, incentives, or benefits previously paid to the wrongful member will not be repaid to the rightful member.
6.5 Independent Direct Sellers must not have interests in competing direct selling companies. This includes: - 6.5.1 Employment, ownership, partnership, or directorship in another direct selling company;
- 6.5.2 Membership in another direct selling company;
- 6.5.3 Selling, distributing, promoting, or recruiting for another direct selling company.
6.6 The company’s decision on violations, such as undercutting or double sponsoring, is final.
COMPANY IMAGE AND REPUTATION
7.1 Members must uphold the company's image and reputation.
7.2 Members must not engage in actions that defame the company or its products, nor participate in illegal activities.
7.3 Members must not use the company’s name for fundraising without written consent.
TRADEMARK(S) AND PACKAGING
8.1 Members must not alter or deface product labels or packaging, nor repackage products.
8.2 Members must not publicly advertise products without written consent from the company.
PRODUCT PRICING
9.1 Members must adhere to the company’s pricing. They cannot set their own prices, offer discounts, or give high-value giveaways in competition with the company.
9.2 Members must not use company products as promotional giveaways without written consent.
9.3 Violation of pricing rules may result in membership termination or suspension, along with all associated privileges and benefits.
RESPONSIBILITY FOR PAYING TAXES
10.1 Members are responsible for compliance with Malaysian tax laws regarding their earnings from commissions or other sources as Independent Direct Sellers.
BREACH OF MEMBERSHIP
11.1 Members terminated for violating company policies will lose all privileges, bonuses, rankings, promotions, and entitlements, including the return of products.
11.2 Terminated members’ accounts will be suspended, and all rights and entitlements voided.
SEVERABILITY
12.1 If any provision of this policy is found to be void or unenforceable, it will be deemed deleted, and the remaining provisions will remain in full effect. The parties will negotiate a satisfactory replacement for the void provision.
GOVERNING LAW
13.1 Disputes arising from this policy shall be resolved in the High Court of Kuala Lumpur or by arbitration as deemed fit by the company. Members shall not seek redress through any other means.
13.2 If resolved by arbitration, a sole arbitrator agreed upon by both parties will be appointed. The forum and type of arbitration will be decided by the company.
13.3 This policy is governed by Malaysian law.
